History
A graduate of San Jose State University, Patrick Markham received his Bachelor of Arts degrees in history with department honors in 1980. While obtaining his undergraduate degree, Mr. Markham was a member of Phi Alpha Theta, history honor society.
Mr. Markham attended the McGeorge School of Law, University of the Pacific, where he participated in the International Moot Court program. He was selected to the International Moot Court honors board, and later served as editor-in-chief of ARecent Developments in Private International Law,@ 1983. After receiving his Juris Doctor degree in 1984, Mr. Markham joined the law firm of Mackenroth, Seley & Anwyl as an associate. In 1987, he joined the firm of Boutin, Lassner, Gibson, Perry & Delehant, where he was able to focus his practice on business and real estate law. In 1992, Mr. Markham left the Boutin firm and opened a solo practice in downtown Sacramento. In 1998 he and his staff joined forces with Richard M. Jacobson, providing a broad base of litigation support for their clients.
Mr. Markham has been admitted and tried cases in Hawaii, Washington, California and Colorado. He argued before the California Courts of Appeal and the Ninth Circuit Court of Appeals. In appropriate cases, he has participated in ADR, whether by mediation or arbitration. Most recently, he argued before the Ninth Circuit Court of Appeal in an action entitled Big-D Construction Corp.-California v Leprino Foods Company, Marelich Mechanical Company, Inc, etc., where the issue was enforcement of an out of state forum selection clause by an out of state owner against an out of state general contractor. A significant issue was the public policy of California mechanics' lien rights versus the sanctity of the contract. The decision is pending. Additionally, he was trial or appellate counsel on the following reported decisions:
FPI Development, Inc. v. Nakashima (1991) 231 Cal.App. 3d 367. Stanford Ranch, Inc. v, Maryland Casualty Company, 883 F.Supp. 493 (E.D. Cal 1995). Stanford Ranch, Inc. v, Maryland Casualty Company (9th Cir. 1996) 89 F.3d 618.
Mr. Markham recently resolved three construction project close outs for a private owner with the result being dismissal by the claimants and final retention sufficient to reimburse the owner client for all fees and costs. He has had demonstrated trial success, and the ability to negotiate successful dispute resolution while containing costs. He is currently lead trial counsel defending an owner in an action involving a total of $50 million in claims by all parties.
Mr. Markham has been a guest speaker for the Sacramento CPA Society. He has served his community as board member and coach of the Folsom American Little League, coach of the Folsom Soccer Club, Cub Scout volunteer and Folsom Hills Elementary School volunteer.
