Carpenter v. Tehachapi-Cummings County Water District – Water district obtains defense verdict.

Tried in August 2018 in Kern County, a jury found Joseph Urbanic and Richard Jacobson’s public entity client not liable for the alleged wrongful termination of Plaintiff. Plaintiff claimed he was terminated for complaining about severe OSHA violations he witnessed while employed. The public entity claimed that Plaintiff was terminated for a physical confrontation between him and another employee, and Plaintiff’s history of aggressive behavior. After Plaintiff’s case in chief, Mr. Urbanic filed a Motion for Nonsuit eliminating six of Plaintiff’s seven causes of action. The jury returned a unanimous defense verdict in approximately 25 minutes. Having served a C.C.P. section 998 Offer to Compromise prior to trial, the public entity recouped its litigation costs.
