Representative Matters
Writ of Mandate and Bid Dispute
Jacobson Markham represented general contractor in a public bid process wherein a public entity awarded a construction contract to the purported low bidder by waiving an irregularity in the bid despite bid protests by the client, who was the second lowest bidder. Successfully moved the court to issue an immediate stay to halt further construction of the public project and then obtained a writ finding the contract was invalid because it was awarded in violation of public contracting law. The court ordered further consideration of the bids which resulted in the $5 million dollar project being awarded to the client.
